MEMORANDA

SHIPSHEWANA TOWN COUNCIL

MAY 9, 2019  6:00 P.M.

COUNCIL MEMBERS PRESENT:  Joshua A. Weimer, Elmer J. Mast, Zachary J. Stoltzfus, Tad T. Hite, C. Arlene Lazzaro.

 

MOTION:  A motion passed to accept the Agenda with flexibility.  The Council President tabled item #4, June 13th Council Meeting Start Time.

 

FIRE DEPARTMENT REPORT:  Council Members considered valve and pump packing repair quotes for Tower 24 and Engine 21.  MOTION:  A motion passed approving the two repair quotes submitted by Dunnys Pump Service of Syracuse, IN to be paid from the Cum Fire Fund in the amount of $1,741.99 for Tower 24 and $2,460.47 for Engine 21.   There were thirty-six calls in the month of April.

 

POLICE DEPARTMENT REPORT:  The Council President stepped down and did not participate in the discussion, motion, or vote for the purchase of vests for the Police Department. The Vice-President conducted the vest purchase portion of the meeting.  The Council considered quotes for thirteen level 3a FLX body armor vests as follows:  Hite Uniform Co. of LaGrange, IN $9,220.12; Brateman’s Inc. of Ft. Wayne, IN $8,411.00; and Galls of Lexington, KY $9,425.00.  MOTION: A motion passed approving the purchase of thirteen level 3a FLX body armor vests from Hite Uniform Company of LaGrange for $9,220.12 to be paid from the CCD Fund.  The Council President resumed his position on the Council.

 

STORAGE CONTAINER PURCHASE:  Council Members considered the purchase of a used 40’ storage container for the Police Department.  MOTION:  A motion passed approving the purchase of a used 40’ ground level container from Kingman Mobile Storage of Elkhart, IN at $3,500.00 to be paid from the Police Firearms appropriation.

 

POLICE DEPARTMENT REPORT:  Council Members were informed that a Police Officer would be on light duty for the next two weeks, Mayfest went well, and violation of a School Bus stop arm could lead to jail time.

 

COMMUNITY CROSSINGS GRANT PROJECT FUNDING:  Council Members were informed that the Community Crossings Grant funding for the S. Morton Street project has been received, but the grant distribution for the E. Middlebury Street project will not be released until July or later.  Discussion followed regarding a funding gap measure to ensure that the E. Middlebury Street project would move forward.  MOTION:  A motion passed authorizing the use of TIF Funds up to $700,000.00 for cash flow purposes until the Community Crossings Grant distribution is received for the E. Middlebury Street project.

 

MOTION:  A motion passed authorizing signature of the Contract with Niblock Excavating, Inc. of Bristol, IN for the 2019 Street Improvements Project at a contract price of $1,239,262.00 between Council meetings.

 

AFFIDAVIT FOR ANNUAL LAGRANGE COUNTY REMC MEETING:  Council Members considered individuals who would vote on behalf of the Town at the Annual LaGrange County REMC meeting in June.  MOTION:  A motion passed appointing Kurt R. Bachman as the voting delegate for the Town of Shipshewana at the Annual LaGrange County REMC meeting.

 

LAND PURCHASE FOR SR 5 SOUTH SIDEWALKS & LIFT STATION:  Council Members discussed the purchase of land for the lift station relocation and new sidewalks for the SR 5 South Improvement Projects.  MOTION:  A motion passed to purchase land from Mr. Glenn Bontrager in the amount of $6,000.00 to be paid from the Sewer Improvement Replacement Fund for the lift station relocation.

MOTION:  A motion passed to purchase land from Marianna Nelson and Jack Nelson for new sidewalks along SR 5 in the total amount of $6,000.00 to be paid from the General Fund.

 

SEWER BILL ADJUSTMENT REQUEST:  Council Members considered a sewer bill adjustment due to a water leak.  MOTION:  A motion passed approving a $38.21 sewer bill adjustment for account #102-

440-34.

 

FINANCIAL REPORT:  The April Fund Report and Net Proceeds Report from the Fire Department Fish Fry were presented for the Council’s consideration.  The Clerk-Treasurer shared concerns regarding the passing of HB 1347 and the affect it could have on collections for the Town Utilities.  Review of this law by the Town Attorney was requested.  MOTION:  A motion passed approving the April Bank Reconciliations and the May 9, 2019 Claims Register.

 

C.A. Lazzaro expressed concern regarding the number of potholes on Berkshire Drive and the lack of street sweeping.

 

Council Members reviewed their letters regarding the May 17th LaGrange County Redevelopment Commission meeting.

 

  1. Hite expressed concern regarding the condition of some alleys in Town. Discussion followed.

 

Westview Government Class student introductions followed.
